Thanks for asking me “Can I get a License if I am a Habitual Traffic Offender / HTO in FL?

If you get designated as a HTO / Habitual Traffic Offender by FL-DMV then 2 things happen to you simultaneously:

1) Your driving privilege gets administratively suspended by DMV for a period of 5 years; and 2) Each and every time that you get behind the wheel of motor vehicle you risk arrest and prosecution for driving on a HTO suspension, which is a 3rd degree felony punishable by 5 years in state prison, 5 years probation, a $5,000.00 fine and a permanent felony conviction.

That said there’s only 3 ways to get a license after DMV designates you as a HTO in FL:

1) Assuming that there are no other or unrelated holds or suspensions on your driving privilege then after serving one full year of your 5 year HTO suspension you’re eligible to apply for a “hardship” or “business purposes only” / BPO license;

2) Within 30 days of the Notice of HTO Revocation from FL-DMV you can file for an administrative hearing to challenge your driving record and demonstrate a legal basis as to why your revocation isn’t valid; or

3) You can hire lawyer to challenge one or more of your underlying / qualifying cases and either seek to get a conviction or 2 set-aside or get a DWLS or 2 broken down to a lesser charge (such as No Valid DL, an offense which does NOT count toward HTO status) thus removing the conviction from your record and removing HTO status from your present situation.
