Gonzalez v. Google has been decided, but what comes next for AI, data privacy, and online content moderation policy is still TBD. Although oral arguments back in February largely focused on Section 230 of the Communications Decency Act, the case inspired debate that extended far beyond potential reforms to Section 230. Given that the opinion declined “to address the application of §230 to a complaint that appears to state little, if any, plausible claim for relief,” this broad debate will likely continue.

As Congress and state legislatures across the country continue considering online content moderation, data privacy, and AI governance legislation, many questions that Gonzalez v. Google raised remain relevant today. Such questions include:
• How will potential legal and policy shifts impact the AI-powered content recommendation systems that underpin the modern internet?
• To what extent should online platforms be accountable to regulatory authorities and the public for the wide range of impacts they have on users and society?
• Does Section 230 apply in whole or in part to content that ChatGPT, Bard, DALL·E, and other generally accessible generative AI systems produce?
