Driver's erratic maneuvers lead to a roadside stop and a series of challenging sobriety tests, revealing significant impairment.

Around 6:27 PM on April 23, 2022, a patrolman observed a 2013 BMW driving erratically on a state route, prompting a K-turn and subsequent pursuit. After the vehicle made several erratic turns, the officer activated emergency lights, bringing the car to a stop on a residential street. The driver, a 37-year-old woman, immediately exhibited slurred speech and appeared confused, stating she was unaware of the reason for the stop, which led officers to suspect possible intoxication. A supervisor and additional officers were called to the scene, where they also noted visible damage on the passenger side of the vehicle's front bumper.

Officers then proceeded to administer a series of standardized field sobriety exercises. During the Horizontal Gaze Nystagmus (HGN) test, the officer observed a distinct lack of smooth eye pursuit and sustained nystagmus, indicating potential impairment. The subsequent Walk and Turn test proved challenging, as the driver struggled to understand and follow instructions, repeatedly stepping away from the designated line. Her difficulties continued with the One Leg Stand test, where she frequently put her foot down and struggled to maintain balance, although she did manage to recite the alphabet without error.

Based on her erratic driving patterns, the observed vehicle damage, and her inability to adequately perform the field sobriety exercises, the driver was placed under arrest for driving under the influence. She was transported to a nearby police headquarters for processing. During a mandatory 20-minute observation period, she invoked her Miranda rights and subsequently refused to submit to a chemical breathalyzer test. After her processing was complete and a potential liability warning form was signed on her behalf, she was released with multiple summonses, including charges for driving while intoxicated, refusal to submit to chemical breath testing, failure to maintain lane, operating an uninsured out-of-state vehicle, and reckless driving.
