Ford v. Trident Fisheries Co. | 122 N.E. 389 (1919)

It happens all the time. Somebody does something dumb. Then somebody else gets hurt. Are those two facts enough to make out a negligence case? That question gave the court cause for contemplation in Ford versus Trident Fisheries.

Ford was employed as a mate on a steam trawler owned by Trident. Shortly after the vessel left Boston, Ford fell overboard. No one heard or saw him in the water afterward.

A boat lashed to the deck was cut loose and lowered into the water. The sailor manning the boat had only one oar, and had to scull, rather than row. But Ford was never found.

Ford’s administratrix, Catherine Ford, sued Trident, alleging that Trident was negligent in having the boat lashed to the deck instead of being suspended from davits, thus delaying rescue efforts. Ford further claimed that the boat’s having only one oar was also negligent. The trial court found for Trident, and Ford appealed.
