What is a third party claim?

If someone other than an injured worker's employer or co-worker causes their workplace injury or illness, the injured worker may then prosecute a lawsuit against the negligent third-party.

The injured worker and their employer are the first two parties and the negligent person has been called the third party.

Because the injured worker has a valid right-to-sue that negligent third-party and collect pain and suffering and other excess damages that cannot be compensated under the basic coverages provided by our workers compensation system.
