I'm going to give you the quick and dirty rundown of domestic violence law in California. I know that it can be confusing, so here it goes. Number one, who does it apply to? It applies to those who are, or have been, in a relationship or have lived together. Two, what's special about domestic violence cases? The potential consequences of a conviction are worse. There are special units within the prosecuting agencies devoted to only handling domestic violence cases. The San Diego district attorney's office calls that unit, family protection. There are two main charges for domestic violence, Penal Code section 243e1 and PC 273.5.

243e1 is domestic battery. 273.5 is corporal injury in a domestic relations setting. The 243e1 requires force or violence against another. 273.5 is the same, but it results in a traumatic condition. This could be a bruise, a bloody nose, markings around neck, et cetera, but these aren't the only ones that fall under the DV law umbrella. Anything, even vandalism, can be domestic violence case and carry the potential for additional punishment. Four, is someone definitely going to jail if the police think that a crime was committed in a domestic setting? You betcha. If you're there, when the cops show up to investigate and it's two fingers pointing at each other, whoever the cops believe, is going for a ride. Their job is made easier if one person has injuries and the other one doesn't. You know what I'm going to say, right? Remember your right to remain silent. Short term talking is too big of a gamble.
