Jancik v. Department of Housing and Urban Development | 44 F.3d 553 (1995)

What may a landlord or seller say in connection with renting or selling a residence? The Seventh Circuit considered that question in Jancik versus Department of Housing and Urban Development.

Stanley Jancik owned an apartment building in Northlake, Illinois. The building housed people of all ages, including children. Jancik placed an ad in a local newspaper offering a vacant apartment. The ad stated, quote, “mature person preferred,” unquote.

The Leadership Council for Metropolitan Open Communities suspected the ad might reflect discriminatory intent. It arranged for testers to pose as potential renters. During conversations with these testers, Jancik indicated he didn’t want teenagers. He also asked one tester about her race and asked another tester about her occupation, age, marital status, race, and whether she had children or pets.

The Leadership Council filed an administrative complaint with the Department of Housing and Urban Development, or HUD. A HUD administrative law judge then conducted a hearing and found that Jancik had violated the Federal Housing Act. The A L J awarded the Leadership Council damages and attorney fees and then imposed a civil penalty. Jancik petitioned the Seventh Circuit for review.
