More than perhaps any other industry, the providers of digital services produce cross-border integration—and depend on a high level of comity and coordination across and among sovereign jurisdictions. To date, regulatory harmony has been hard to come by. On antitrust policy, data protection, content restrictions, and other issues of central concern to the providers, the EU and the U.S. (and, within those unions, individual member-states) have often gone their separate ways. So far, the firms have proven capable of adjusting to the frictions and the attendant costs. But a basic questions still lurks. Is there a way a managing real-world problems in this sector within a competitive framework—or must the firms fear the prospect of being run as de facto public utilities?
