Here are some key points about the H-1B visa:

Eligibility Criteria:

Cap Limit:
There is an annual cap on the number of new H-1B visas issued each fiscal year. As of my last knowledge update in September 2021, the regular cap was set at 65,000, with an additional 20,000 visas available for individuals with advanced degrees from U.S. institutions.

Employer Sponsorship:
The employer must petition for the H-1B visa on behalf of the foreign worker.
The employer is responsible for filing the necessary paperwork and meeting specific requirements.

Duration:
The initial period of stay on an H-1B visa is up to three years, with the possibility of extension for another three years.

Dual Intent:
H-1B visa holders are allowed to pursue permanent residency (a green card) in the U.S., and the H-1B visa is considered a "dual intent" visa.

Dependents:
H-1B visa holders can bring their spouses and unmarried children under 21 years of age to the U.S. as dependents on H-4 visas.

Change of Employer:
H-1B visa holders can change employers, but the new employer must file a new H-1B petition.
