Florida’s drug trafficking statutes are already intense, but they get worse when substances are deemed “synthetic.” In State of Florida v. Arshadnia, law enforcement found over a thousand grams of THC-laced cereal bars and slapped a 15-year mandatory sentence on the defendant for trafficking in synthetic cannabinoids. 2023 WL 8793248.

But here’s the kicker: the FDLE lab couldn’t conclude that the THC was man-made rather than plant-based. They literally said “inconclusive”—so the trial court tossed out the trafficking charge entirely, a decision the appellate court upheld. That’s huge. Proving “synthetic” means showing it’s artificially created, not just derived from a cannabis plant. If the chemist can’t testify confidently it’s synthetic, the state’s case goes out the window.
