How do you file a writ petition in high court? What all do you need? Are there some things you must know that’ll make it easier for you?

Let’s say you have to file a Income Tax Writ Petition in Bombay High Court.

Your petition must contain-
1. Index
2. Proforma
3. Synopsis
4. Copy of Petition (name of parties, prayers, jurisdiction, cause of action, limitation must be well defined and clear)
5. List of documents you’re relying upon
6. Exhibits (for example, return of income, notice from income tax authority, your reply to notices, etc.
7. Affidavit in Support
8. Certificate
9. Presentation form
10. Docket

Once these things are ready, you may file it in the filing department.

However, how do you present it in filing department? Can you just shove your bunch of paper to the filing department? Is there some procedure or rule to be observed?

1. Petition has to presented a in file/wrapper (as shown in video.

2. Cardboard (as shown in video) has to be attached and stitched in a green thread.

3. Court fee of ₹250 in the writ petition has to paid. You can do either buy stamp paper worth that amount or buy court fee labels or a combination thereof.

4. For Vakalatnama, ₹15 label is required

5. For verification, another ₹15 label is required (which has to be later cancelled by court associate

6. Welfare stamp worth ₹20 has to be attached as well

BTW you can take help of a clerk in this. They are experts. The following is just for your information, you need not do it yourself.

These are things you’ll learn with experience and need need do later. But, if you know these things no one can overcharge you and make filing easier. Hope this helps!
