If a plaintiff’s building is damaged by the defendant, what does the defendant owe? Does it matter who uses the building? A church is rocked to its very foundation in Trinity Church in City of Boston versus John Hancock Mutual Life Insurance Company.

Boston’s Trinity Church was designed by Henry Hobson Richardson and completed in 1876. It’s considered one of Richardson’s greatest works and is a national historic landmark as well as a functioning church. Trinity was built out of stone masonry, which is brittle and prone to serious cracks that ordinarily can’t be repaired except by disassembly, resetting, and reconstruction. John Hancock Mutual Life Insurance Company constructed a new tower next to the church. During construction, the tower’s excavation work caused Trinity’s foundation to shift, which resulted in a spray of cracks up Trinity’s masonry walls that affected the church’s structural integrity.

Trinity sued John Hancock, and the trial court awarded Trinity over $4 million in damages for repairs. John Hancock appealed to the Massachusetts Supreme Court, arguing that the proper measure of property damage is the loss in market value of the property.
