Did you know that before 2018, adultery in India was not just a ground for divorce but also a criminal offence punishable with 5 years in jail?
Under Section 497 of IPC, if a man had an affair with someone’s wife without the husband’s consent, he could be jailed. Shockingly, only the man was guilty, while the woman was considered free of liability!

But in Joseph Shine v. Union of India (2018), the Supreme Court of India declared this law unconstitutional. The court ruled that:
✅ Right to live with dignity and personal autonomy means the state cannot interfere in private adult relationships.
✅ Adultery is a private matter, not a criminal one.
✅ Today, adultery can still be a ground for divorce, but it is not a crime anymore.
