Why is it important for the injured victim to provide the at-fault driver's insurance company with pre-accident medical records? Well, the answer is simple. As the injured victim who is seriously injured in a motor vehicle accident and they're bringing their personal injury claim against the at-fault driver's insurance company, they want to make sure that the insurance company has everything they possibly need to evaluate the case. And also to show that the injured victim has nothing to hide. Now there are times where injuries from the accident are rather obvious. Maybe broken bones, immediate surgeries, things of that nature. But there are other times where the injuries may not be so obvious. The at-fault driver's insurance company may say, well the injured victim had this pre-accident pre-existing medical condition; So the injuries that they're now claiming may not actually be from the motor vehicle accident itself.

By providing the at-fault driver's insurance companies all of the injured victims pre-accident medical records, maybe from three years before the accident up to and through the time of the accident, the insurance company can evaluate the pre-accident medical records to actually see if
the injured victim's claimed injuries are from the accident or from something else. It also gives the injured victim an opportunity to make an argument to the at-fault driver's insurance company and in court that even if the person had a pre-existing medical condition, an injury they were suffering from before the accident happened, that injury was substantially aggravated by the motor vehicle accident itself.
