Botswana is discussing the creation of a Constitutional Court. But an important question remains. Should the country introduce a Constitutional Court under the current Constitution, or should we first carry out a full constitutional review that involves the people from start to finish.

In this video I discuss the role, powers and jurisdiction of a Constitutional Court. I also explain why I believe that before any reform, the public must be fully educated on their rights and options. Citizens should decide the review model they want. It must be a bottom up, holistic and comprehensive process that produces a people’s Constitution.

I explain why the Constitutional Court should be created only under a new Constitution. I also explore what lessons Botswana can learn from other countries and why civic education is key before any amendment or reform.
