Robert Cook was convicted of second degree murder and sentenced to 30 years in prison, as well as 15 years for using a handgun in a crime of violence. Cook appealed, arguing that the court failed to distinguish between second degree depraved heart murder and involuntary manslaughter in its jury instructions, and that the State was allowed to introduce irrelevant testimony. The case involved Cook shooting Kathryn Burns, his girlfriend, in the back. Witnesses testified that Cook was angry and had threatened one of Burns' co-workers before retrieving a gun and shooting Burns.

The most relevant facts to the court's analysis were whether the trial court correctly instructed the jury on the differences between depraved heart murder and involuntary manslaughter and whether the State was allowed to introduce relevant testimony.
