The Supreme Court strongly criticized the Chhattisgarh police for misusing the Unlawful Activities Prevention Act (UAPA) against an accused immediately after he was granted interim protection from arrest in another case.

A bench of Justices Abhay S Oka and Ujjal Bhuyan called this police action “gross impropriety” and warned of criminal contempt proceedings. The Court noted that the police officer was aware of the protection order but still hurriedly invoked UAPA to ensure the accused’s arrest.

The State argued that the accused had jumped bail in other cases and that the UAPA charge was added based on new evidence. However, the Court held that the police should have sought prior permission before taking such action.

The Court concluded that this move was a deliberate attempt to nullify its interim order and granted bail to the accused in the related case.
