Liberal Senator Sarah Henderson has slammed the Victorian government’s “serious breach of human rights” and has called for intervention from the Human Rights Commission.

“As a Senator for Victoria it’s my assessment that this curfew is in breach, serious breach, of human rights,” Ms Henderson told Sky News host Chris Kenny.

She said among the numerous potential breaches relating to Victoria’s 8pm curfew, the right to freedom of movement is of particular note.

“The right to freedom of movement can be limited if it’s justifiable (but) there’s no rational objective of this curfew. There’s no health rationale, and there is no request by the police”.

Victorian Police Chief Commissioner Shane Patton revealed on radio the police were not consulted before the implementation of a curfew in Melbourne, claiming it was the Chief Health Officer's idea.

His comments contradicted remarks made by Chief Health Officer Brett Sutton who denied being involved in the decision and Victorian Premier Daniel Andrews who claimed the curfew in Melbourne was designed to help Victorian police enforce lockdown rules.

Ms Henderson said the decision was “completely improper” and led her to make contact with the Human Rights Commission.

“This is tantamount to a police state,” she said.

“This is megalomania out of control.”
