(8 Oct 2019) Plaintiffs and defendants responded to a seemingly divided US Supreme Court that was considering whether federal civil rights law protects LGBT people from job discrimination.
One of the cases brought before the court dealt with fired transgender funeral home director Aimee Stephens, who was in the courtroom for Tuesday's arguments.
Stephens lost her job when she told Thomas Rost, owner of the Detroit-area R.G. and G.R. Harris Funeral Homes, that she had struggled with gender identity issues almost her whole life. She was planning to exchange the dark suit and tie she had worn to work for nearly six years as an embalmer and funeral director for a conservative dress or skirt that was required for women who worked for Rost.
Stephens said after the hearing, "I'm glad to have been able to bring this before the court. And what happen to me is wrong."
After the hearing Rost said, "I determined we could not go along with the employee's proposal. It was a difficult choice but I felt it was in the best interest of the grieving families our business serves."
Justice Neil Gorsuch said in arguments Wednesday that the case seems closed but he wonders whether the justices should consider "the massive social upheaval" that might follow a ruling in favor of LGBT employees.
The court's four liberal justices appeared likely to vote that a key provision of the Civil Rights Act of 1964 that prohibits discrimination in employment on the basis of sex should encompass both sexual orientation and transgender status.
Lawyers for the plaintiffs would need one additional vote to prevail. Gorsuch is one possibility. Chief Justice John Roberts and Justice Brett Kavanaugh did not squarely indicate their views.
