In every failure to diagnose case there is always a delay in diagnosis. As a result of that delay, the patient usually continues to suffer harm from the condition or disease that went undiagnosed.

For example, cancer might continue to spread if undiagnosed and not timely treated. If a fracture is not timely diagnosed in the emergency room, the patient will return Home to walk on it for days or weeks until they finally seek additional medical care.

One of the key questions that every attorney must investigate in order to determine whether it is a valid medical malpractice case here in New York is whether the treatment or outcome would be different if her condition had been timely diagnosed and treated.

In the examples used above, if the cancer had been recognized early would you still have needed all the treatment he went through? Would your prognosis and life expectancy be different if this was quite earlier?

Using the example of the fracture that went undetected, chances are you may need surgery anyway to fix the fracture. If so, how would your treatment have been different if this was diagnosed earlier?
