PRO and CMO are terms that you hear a lot in the music industry. Almost every territory in the world has their own PRO or CMO. These organizations represent rights on behalf of music around the world.

PROs are Performing Rights Organizations and involve licensing and collecting royalties for the performance right of copyright. They are usually responsible for licensing the territory in which they are located. It’s important to remember that PROs do NOT collect mechanical royalties.

In 1842, the UK Copyright Act created the first PRO for musical rights call simply the Performing Rights Society or PRS as it’s commonly known today. In the US, there are four PROs for music publishers and songwriters - ASCAP founded in 1914, SESAC founded in 1930, and BMI founded in 1939. In Puerto Rico, there is also the ACEMLA (Asociacion de Compositoes y Editores de Musica founded in 1953. More recently in the US, GMR (Global Music Rights) was founded in 2013.

We get into a deeper discussion about the US PROs in another one of our 5 mins or less videos, but I do want to make sure to note that ASCAP, BMI, SESAC, & GMR - handle the performance right for compositions and represent songwriters & music publishers. They do not collect mechanical royalties - those are handled in the US by Music Reports, HFA, and the MLC.

Another PRO in the US is SoundExchange which licenses and collects for the performance right on master recordings/sound recordings. SoundExchange does not collect on behalf of songwriters and music publishers.

PROS around the world include SOCAN in Canada, AKM in Austria, and KODA in Denmark.

So then what is a CMO. A CMO is a Collective Management Organization. and they represent not only the performance right for music in their territory but also the mechanical rights as well.

Examples are GEMA in Germany, SACEM in France, SUISA in Switzerland, and FILSCAP in the Philippines.

If you are a songwriter or music publisher, make sure you know which organization represents your rights in your territory. The governing body for PROs and CMOs is CISAC the International Confederation of Societies of Authors and Composers.
