On October 11th, USCIS issued clarifications regarding the sustainment period for EB-5 investments. For investors who committed funds after March 2022, the sustainment period begins when the funds are made available to the project (the job-creating entity). These funds can be returned to investors after two years, contingent on meeting the job creation requirement.
The minimum term for new investments is now 2 years, but the actual investment duration will vary based on the Regional Center and specific project details.

These new regulations are applicable to investors who started their investments after March 2022. For investors who initiated their investments before March 2022, the existing rules remain unchanged - a 2-year period after receiving a conditional Green Card.

The EB-5 program is a US Government program that allows you to obtain a Green Card through investment and job creation in the United States. For each investment, the investor, spouse, and children under 21 can receive a Green Card.
