STATUTORY RAPE DEFENSES

Three common defenses to fight Nevada charges of statutory rape – legally called statutory sexual seduction – are:

1) The defendant was falsely accused. In these cases, a criminal defense attorney would try to impeach the accuser’s credibility and find evidence – such as texts or voicemails – that show the accuser’s motives for lying.
2) The alleged victim was old enough to consent. Statutory rape charges in Nevada do not apply when the victim is at least 16 years old, which is the state’s age of consent. And under Nevada’s Romeo & Juliet law, even 14- and 15-year-old minors are legally allowed to consent to sex with someone less than four years older than them.
3) No penetrative sex occurred. Statutory rape does not apply to situations where there was only groping. But note that defendants could face separate lewdness charges for any non-penetrative sexual conduct with a minor under 16.

Also note that it is not a defense to statutory rape charges if the defendant genuinely believed the victim was old enough to consent, if the victim lied about his or her age, or if the victim initiated the sexual activity.
