Home Minister Amit Shah introduced three bills in the Lok Sabha on 20 August 2025:

The Government of Union Territories (Amendment) Bill, 2025
The Constitution (One Hundred and Thirtieth Amendment) Bill, 2025
The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025

These bills include a provision that if the Prime Minister, a Chief Minister, or any minister is arrested or kept in custody for 30 days in a case that carries a punishment of five years or more, they can be removed from office.

The move sparked uproar in the House, with the Opposition demanding the withdrawal of the bills. The Congress and AIMIM leader Asaduddin Owaisi opposed the measures, while the Samajwadi Party branded them “anti-justice” and “unconstitutional.”
Shah asked that the bills be referred to a Joint Parliamentary Committee (JPC).

The debate also drew reference to past cases: Delhi CM Arvind Kejriwal, who became the first sitting chief minister to be arrested and spent six months in jail without resigning, and Tamil Nadu minister V Senthil Balaji, who stayed in custody for 241 days before stepping down.
