The difference between arbitration, or ADR, and litigation is as follows. Litigation involves filing an action in a court. In our instance, most of the time it's in the Supreme Court of New York State which is the trail level for disputes over $25,000 or where there is equitable relief being requested by the plaintiff. Alternate dispute resolution is filed... again, the differences are the filing fees are a lot less. Service of process costs a lot less.
