So, what is a Lasting Power of Attorney?
Some may have heard of an enduring power of attorney. This was phased out in 2007 and replaced by the LPA's (Lasting Powers of Attorneys) we have today.

Simply put, an LPA puts in place a document which states who you wish to act on your behalf and make decisions if you find yourself mentally impaired or incapacitated and unable to communicate with dementia.

There are two types of LPA that you can put in place: Property & Financial and Health & Welfare. You are able to choose who could act as your attorney. It is also worthwhile nominating a reserve if possible.

Property & Financial
Did you know that only 12% of the UK population have an LPA? (Source: bbc-law.co.uk). If you don’t have an LPA and you find yourself incapacitated, your partner or family will be restricted access to your bank account and will not be able to deal with any of your services set up e.g. utilities companies as this will be deemed “for your own protection”.

If you’ve set up an LPA and chosen an attorney they can work on your behalf and ensure that you have everything available that you need.

Health & Welfare
As we age, it is likely that we will increasingly need more care. In the UK alone emergency admissions have risen substantially over the past decade, increasing by an average of 2.4 per cent a year between 2007/09 and 2016/17 with older people accounting for over half of that growth (Source: AgeUK).

Ageing is a fact of life. And so is the increase in physical and mental conditions but if you have an LPA assigned to you, they can make the decisions for you should you require medical care. For example, if it has been your stated wish to remain at home as long as possible then that will make it easier too, while it is still possible and practical.
