This video is part of my series on the meaning of clauses you'll commonly see in contracts as an indie filmmaker, and how you can use them to put yourself in the best legal position possible.

This video is about an "image, voice and likeness" clause, which essentially gives the production company the right to use the video and audio recordings they made of an actor, or of someone else who appeared the film. Ideally, this clause gives the filmmaker the broadest rights possible to use those recordings -- for example, by saying the filmmaker can use the recordings "in perpetuity" (forever) and "throughout the universe."

It's important to have this type of clause in the contract of everyone present on the set of your film, because many states have laws prohibiting the use of someone's image or likeness for commercial purposes without their consent, and thus it's clear to have written consent to use footage of everyone on set. You'll need this clause for crew as well as talent, so that you have the flexibility to use any photos or video you may take that include crewmembers in bonus materials, on social media, and so on.
