Virginia Uranium, Inc. v. Warren

Article 6, Paragraph 2 of the U.S. Constitution, otherwise known as the Supremacy Clause, provides that the Constitution itself and all federal laws enacted under it supersede any conflicting state constitutional provisions or state laws and preempt them. In Virginia Uranium versus Warren, the United States Supreme Court considered whether a Virginia state law that was enacted to prohibit uranium mining was preempted by the federal Atomic Energy Act.

Virginia law prohibited uranium mining by preventing state agencies from accepting uranium-mining permit applications. But Virginia Uranium wanted to mine uranium from its leased land.

The federal Atomic Energy Act, or AEA, gave the Nuclear Regulatory Commission, or NRC, authority over the milling, transfer, use, and disposal of uranium. However, the AEA didn’t change a state’s authority to regulate uranium mining activities on private lands.

Virginia Uranium sued Virginia in the federal district court for declaratory and injunctive relief, arguing that Virginia’s uranium mining ban was preempted by the AEA. John Warren, Virginia’s Department of Energy Director, and others moved to dismiss for failure to state a claim, which the court granted. Virginia Uranium appealed to the Fourth Circuit, which affirmed. The United States Supreme Court granted cert.
