In this video, I show you how to prepare your grounds of appeal to the First Tier Tribunal in relation to immigration decisions. The online immigration appeal form requires you to state your grounds of appeal, and the deadline for appeals does not allow you a great deal of time to wait. This video deals with the First Tier Tribunal appeal process and provides you with some sample grounds of appeal if you are continuing your immigration appeal online.
Do remember that if you are in the UK then your appeal must be lodged with the tribunal within 14 calendar days of the date that you were sent the notice of the decision. If you are outside of the UK then you must appeal within 28 calendar days from the date that you received the entry clearance decision.
There is no automatic right of appeal to the Immigration Tribunal. Your decision letter should normally tell you whether or not you have a right of appeal (although the Home Office sometimes get this wrong). You should take legal advice in all cases. Most immigration applications do not have a right of appeal. Instead, if they are going to be challenged then this should be by Administrative Review, or Judicial review rather than through an appeal.
