An allegation of careless driving, also known as inconsiderate driving or driving without due care and attention, can only succeed if the prosecution prove that your driving fell below the standard expected of a competent and careful driver; or that you did not show reasonable consideration for other pedestrians and vehicles on the road.

The Law:

It is an offence to drive in a public place without due care and attention. If a Garda believes that you have driven carelessly, but no accident resulted, the Garda can issue you with 2 penalty points and an €80 fixed charge for “driving without reasonable consideration”. This rises to 4 points and €120 in court.

There are a number of other offences based on disobeying road signs, or acting carelessly, and these mainly attract penalty points and fixed charge notices. Examples include failure to yield, breaking traffic lights, and failing to stop at a junction. You can read a full list of penalty points offences on rsa.ie.

If the offence is more serious, you could be convicted of careless driving and fined up to €5000. If you are convicted of careless driving causing death or serious bodily harm, you could be fined up to €10,000 and imprisoned for up to 2 years, or both.

There is no statutory definition of what constitutes "due care and attention".
Whether driving is regarded as careless driving or dangerous driving will depend on the facts of each case.

What are the Defences open to you?

That the driving alleged does not constitute Careless Driving;
Duress;
Mechanical defect;

Penalty

A disqualification order of not less than two years for a first offence and a mandatory disqualification order of four years in the case of a second or subsequent offence within three years.

In the case of a first offence, the court has a discretion not to impose any disqualification order, if significant mitigation is accepted by the Court.
That mitigation is one which should be carefully prepared by you and your lawyer.
