Taylor Swift fought a five year legal battle over plagiarism allegations on her 1989 hit song “Shake It Off.” Songwriters Sean Hall and Nathan Butler claimed that Taylor Swift's chorus in “Shake It Off”, which featured the lyrics "Cause the players gonna play, play, play, play, play, and the haters gonna hate, hate, hate, hate, hate," infringed on their copyrighted work on a 2001 song "Playas Gon' Play" by R&B group 3LW.

In 2018, U.S. District Judge Michael W. Fitzgerald ruled in favor of Taylor Swift, stating that the phrases "players gonna play" and "haters gonna hate" were too generic and lacked the required level of creativity for copyright protection. That ruling was overturned in 2019 by the Ninth Circuit Court of Appeals which found “enough objective similarities exist” that copyright infringement should be “decided by jurors not judges.” Years of legal back-and-forth ensued before a trial date was finally set for January 17, 2023. Several weeks before, attorneys for Taylor Swift and the songwriters filed a petition to withdraw the lawsuit, indicating that a settlement had been reached.

In this short, Blake McCoy recaps the five-year “Shake It Off” lawsuit. Taylor Swift could have won at trial but had good reason to avoid a courtroom. The calendar provided added incentive to reach a settlement. ”Shake It Off” was initially released in 2014 as the lead single for Taylor Swift's first pop album, 1989, and was re-recorded in 2023 for 1989 (Taylor‘s Version).
