The Supreme Court recently held in a case that the Magistrate should order the police to investigate the mattter under section 156 (3) of Crpc if offence is cognizable Nature.
the discretion under section 156 (3) should not use in Arbitrary manner and must be guided by judicial reasoning.
The Police is duty bound to register the FIR if offence is of cognizable nature.
