I had not seen the initiating document for a non-judicial foreclosure prior to a couple of weeks ago. It turns out to be quite informative. In one of the cases discussed in this video the letter clearly states that the “foreclosing entity” is foreclosing on the property as a means to collect “reasonable attorney fees”

TO COLLECT REASONABLE ATTORNEY FEES!!!!

It goes on to state that the “sale” is subject to “ (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.” It even identifies the holder of the duly endorsed Note, and who holds the Security Deed.

It just seems like a good idea to “ask” the holder of the Security Deed (Deed of Trust or Mortgage) for an “audit of the status of the loan”. Perhaps someone will.

PLUS… examples of “letters” submitted to the Chief Judge of a particular jurisdiction, and what appears to happen. No its not a complete remedy, but it is certainly “different” and I believe can lead to the remedy.
