Head of the family, whatever this person says becomes the fate of the family. In fact, this is not only a family matter but a concept under Hindu Law surrounding the authority, powers and obligations of the eldest member of the family, known as Karta. 


A Karta is legally bound to safeguard the interest of the family, its properties and business. So the question arises, can a Karta sell off family properties as per own whims and fancies, or does the Karta need consent from other family members?


This aspect was answered by the Supreme Court in a recent case. The Court explained that a Hindu Undivided Family is capable of acting through its Karta in the management of joint family property. It further clarified that none of the other members of joint family need to be consenting parties to the alienation. 


However, post alienation of such property, a coparcener may challenge the act of a Karta if the alienation was not done due to a legal necessity or for betterment of the estate.
