KARACHI: G M Jamali, President Pakistan Federal Union of Journalists (PFUJ), and Rana Muhammad Azeem General Secretary had welcomed the striking down of Pakistan Electronic Crimes Act (PECA) Amendment Ordinance by the IHC. 

Admitting the PFUJ petition, Chief Justice of Islamabad High Court Athar Minallah has declared (PECA) Amendment Ordinance as unconstitutional here on Friday 8th of April, 2022. It is universally reckoned as PFUJ’s landmark victory in its endeavor for the right to expression.

It may be recalled that by means of PECA Amendment Ordinance Govt had introduced laws to empower Federal Investigation Agency (FIA) to act independently registering cases against journalists on charges of fake news and defamation of political leadership.

Punishment of five years incarceration was also introduced to curb the freedom of speech.

The PFUJ took the lead and not only raised voice against this draconian law but also filed a petition in the Islamabad High Court through its Executive Committee Member Rizwan Qazi from Islamabad.

Adil Aziz Qazi advocate pleaded the case while renowned journalist Hamid Mir was appointed to assist the court.

Following the first hearing, some other organizations including PBA also filed petitions against the PECA Amendment Ordinance which were clubbed with the PFUJ petition.

Petitioners’ lawyers,  pleading that FIA had been abusing powers under the umbrella of PECA Amendment Ordinance, prayed the court to declare it unconstitutional.

Islamabad High Court noted: “The criminalization of defamation, protection of individual reputations through arrest and imprisonment and the resultant chilling effect violates Constitution and the invalidity thereof is beyond reasonable doubt.”

Chief Justice noted: “The criminalisation of defamation, protection of individual reputations through arrest and imprisonment and the resultant chilling effect violates the letter of the Constitution and the invalidity thereof is beyond reasonable doubt.”

The Court  declared the promulgation as unconstitutional stating that: “PECA amendment was in derogation of the Constitution and the fundamental rights guaranteed thereunder, particularly Articles 9, 14, 19 and 19-A"#NewsPakistanTV
