Still the alleged entity COUNTRYWIDE HOME LOAN had went out of business July 2008 and the PROOF @ The San Joaquin County Recorders PROVE beyond a REASON OF A DOUBT that (CWHL) NEVER Assigned/ or Recorded ANY MORTGAGE in San Joaquin County Recorders that show ANY assignment from COUNTRYWIDE HOME LOANS to BANK OF AMERICA/BAC to "RECONTRUST COMPANY" which is a subsidiary of BANK OF AMERICA.

This is A violation of UCC subsection 9-206 Chain of Endorsement.

However it was BANK OF AMERICA/BAC which did the hostile takeover of the property without filing ANY Summons, Complaint, Bonds, Affidavit secretly conspired and transferred the property with the help from the conspirator of their shadow subsidiary RECONTRUST COMPANY to Wells Fargo Bank.

ALL Parties above are in DISHONOR have ACQUIESCENCE to the 30 day & 14 day notarized letters under the FEDERAL DEBT COLLECTIONS PRACTICE ACT which proves that there was "NO Debt." and they were NEVER the LENDER.

In addition this Violates " The National Currency Act of 1863 Section 27" which states that it is forbidden for Banks to illegally pass and sell unregistered INSTRUMENTS.

Show the fact that the Mortgage is Now a Certificate of the YEAR of 2005 by FR which is FREMONT BANK and that TRUST had been CLOSED since NOVEMBER 4, 2005

In Conclusion Welll Fargo Bank is DECEIVING the Courts with TITLE of a CLOSED TRUST never HAD ANY STANDING. "This is GRAND THEFT"

This Trustee has Violated the PSA and showing in the Prospectus 424B5 250th page of 340 states that the TRUSTEE may NOT SELL or otherwise liquidate the collateral securing the notes of a series following an event of a default.

In addition the SEC states the ONLY true TITLE for the Trustee is "Wells Fargo Bank National Association" Located on Page 424B5 4th Page of 340

Therefore Wells Fargo Bank stated "A Mistake of Law and A Mistake of Fact which violates Cal Civil Code 1688-1689"

Also this TRUST Securitized Asset Backed Receivables LLC Trust 2005-FR5 had a cut off date of October 1, 2005 and a Close date of November 4, 2005 which means they are 5 years too late and the TRUST was Closed.

In conclusion they're double dipping on a (Secured Defective Asset) NEVER had any STANDING...

Violating the PSA and the Consent Judgment and Orders and being guilty on December 23, 2010 of foreclosure fraud of robosigning over 50,000 documents...

IS VOID because it also violates the IFC which conclude that this property was active in the wrongful foreclosure process between January 1, 2009 and December 31, 2010 did send out a letter confirmation PROOF that BANK OF AMERICA claimed on written Documents that it was the "LENDER" and the "SERVICER".
