Choi's decision to fill two judicial vacancies has increased the Constitutional Court's judges to eight members, requiring six votes to decide Yoon's impeachment case. This move drew criticism from the ruling People Power Party, which called it a unilateral action lacking sufficient consultation.

Yoon Suk Yeol faces rebellion charges and has been issued an arrest warrant, making him the first sitting South Korean president to face such circumstances. Meanwhile, Choi has served as acting president since December 27, 2024, following the parliamentary impeachment of Prime Minister Han Duck-soo.
