a) unofficial extension of objectivism (cross-bridge between legal and political philosophy)
b) statements Ayn Rand made support declarationism
c) basic principle is that the government does not have the right to violate your rights
d) has not ever had this right
e) declaration of independence formally incorporates this into legal philosophy, and legal system
f) government not having right to violate your rights is not dependent on declaration of independence
g) unalienable rights cannot be delegated to the government, regardless of personal desire, or how clever an argument is to accomplish this
h) DOI is superior to federal and state constitutions
i) nothing in the constitution can be understood to violate unalienable rights, or violate the DOI in any manner what so ever
j) all rulings to the contrary are null, void, illegal, and of no effect
k) any agent of government who enforces an illegal law is committing a criminal act
l) The constitution is not an unlimited power document : you cannot put anything you want into it (regardless of vote, ratification, rulings, branches of government, etc)
m) legal philosophy is not a "floating abstraction". It is not whatever you want it to be. It does not depend on personal values, goals, and intentions
n) it is illegal for the government to violate your rights in any manner, it always has been, is now, and always will be, regardless of geographical area, age, gender, race, etc.
