What Is an Export?

Understanding what constitutes an export is important or you might find yourself in violation of Bureau of Industry and Security (BIS) regulations. And chances are, the definition is more wide-ranging than you think. In fact, you can be an exporter without sending anything out of the country.

According to U.S. export regulations, an export is any item sent from the United States to a foreign destination, organization or individual. Here are some examples of when an item is being exported:

—You’re sending it to a foreign embassy located in the U.S.
—It’s leaving the U.S. temporarily. Let’s say you’re taking your laptop with you on a business trip.
—It’s leaving the U.S., but it’s not for sale. For example, samples for a tradeshow.
—You’re sending it to a wholly-owned U.S. subsidy in a foreign country.
—You’re releasing—or sharing—technology or source code that is subject to U.S. export controls to a foreign national located in the U.S. This is “deemed” to be an export or, as the regs call it, a deemed export.

So, yes, you can be an exporter without sending anything out of the country.
