USFL v. NFL | 842 F.2d 1335 (1988)

In 1983, a new professional football league emerged, the United States Football League, or USFL. After losing nearly 200 million dollars in its first three years and trying unsuccessfully to secure a network television contract, the USFL did the last thing it could think of, file an antitrust suit against the National Football League, or NFL. The Second Circuit considered the case in USFL versus NFL.

The USFL brought suit against the NFL for violations of Sections 1 and 2 of the Sherman Act. USFL alleged that the NFL willfully established and maintained a monopoly in the market for professional football by entering restrictive agreements with the major television networks.

The jury found that the NFL had violated the Sherman Act but only awarded nominal damages. In addition, the jury rejected the USFL’s primary argument that the NFL had denied it access to network television. The USFL appealed to the Second Circuit.
