What is Probate? Probate is the court to which you take a will after someone passes, or the court to which you go after someone passes without a will to get their assets distributed among their heirs. How does probate work? A person who wants to be the personal representative or executor petitions the court, either with the will or without a will, stating their reasons for being the personal representative. If there is a will, normally this will be their nominated personal representative. If there isn't a will, they're a person who's accepted by Colorado statute to be the next person in line to be the personal representative. This person petitions the court to be personal representative, provides a lot of lengthy and detailed documentation, after which the court approves it and provides them letters of testamentary if there is a will, or letters of administration if there is no will. The personal representative then goes forth and administers the estate in compliance with Colorado law.
