A federal judge on Friday froze the Centers for Disease Control and Prevention’s stringent reopening policies for cruise lines in Florida, setting the stage for cruise ships to leave port earlier than expected, giving Florida an early victory in its legal battle against the CDC. Florida Gov. Ron DeSantis (R) hailed Merryday’s decision. “Today, we are securing this victory for Florida families, for the cruise industry, and for every state that wants to preserve its rights in the face of unprecedented federal overreach,” he said in a statement. The CDC can propose a narrower injunction within the next two weeks, Merryday ruled. The judge also told Florida and the CDC to enter mediation, though a previous attempt to mediate the dispute failed without a resolution earlier this month. With their crowded living arrangements and communal activities, cruise ships were the scene of a number of prominent outbreaks at the start of the Covid-19 pandemic, with more than 700 passengers and crew contracting the coronavirus on the Japan-based Diamond Princess in January 2020. As a result, American cruise lines voluntarily cancelled voyages starting last spring, and the CDC imposed a mandatory “no sail order” from March to October. The CDC now has a phased reopening plan for the cruise industry: Companies are required to set up onboard testing labs for crew, certify their ships with the CDC and hold simulated cruises before resuming their normal operations, and tight social distancing rules will remain in place unless 95% of crew and passengers are fully vaccinated. Major cruise operators — which have lost billions of dollars over the last year — have slowly worked their way through these requirements, with lines like Royal Caribbean and Carnival set to hold test cruises within the next month. Even as the number of new Covid-19 cases falls and vaccination rates soar, U. S. cruise operators are still struggling with outbreaks as they try to reopen. Royal Caribbean’s Celebrity Millennium set sail from St. Maarten earlier this month, the first cruise ship to depart from a North American port in more than a year, but two passengers tested positive for Covid-19. Plus, Royal Caribbean postponed the Odyssey of the Seas’ maiden voyage after multiple crew members tested positive.
