The Burgos family acquired a photo of missing member Jonas purportedly taken while he was in custody of the Philippine Army. The photo, along with other reports that were filed with the Philippine Army, were submitted to the Supreme Court as "new evidence" for the continuation of the case.

Mrs Burgos said his son looked dazed in the photo. She also said that when Jonas left home on the day he was abducted he was wearing a white t-shirt that he appeared in the photo. A piece of black cloth could also be seen in the photo that Mrs Burgos surmised must have been used to blindfold his son.

Four days prior to the filing of the motion the Philippine Appellate Court decided that officers of the Philippine Army were responsible for the abduction of the missing agriculturist-activist.
