Certain Colorado crimes carry harsher penalties if the defendant’s actions caused someone else to sustain serious bodily injury. Here are three things to know about this sentencing enhancement:

1. Serious bodily injuries involve a substantial risk of death, serious permanent disfigurement, or protracted loss or impairment of the function of any part of the body. Common examples include broken bones or second- or third degree burns.
2. Whether a serious bodily injury occurred can be subjective and is often a matter of degree. In cases that go to trial, defendants can call expert witnesses to argue that the victim’s medical records indicate no serious bodily injury. Ultimately, the prosecutor has the burden to prove beyond a reasonable doubt that any injuries the victim sustained were serious.
3. In assault cases, penalties largely depend on whether a serious bodily injury occurred. An intentional assault with serious bodily injury by means of a deadly weapon is a class 3 felony, carrying up to 32 years in prison. An intentional assault with a serious bodily injury without a deadly weapon is a class 4 felony, carrying up to 16 years in prison.
