A lot of people assume that because of the phrase [“doctor-patient confidentiality”], anything they say or anything they do in a doctor’s office is 100% confidential and no one else can ever learn about it.

That is absolutely not true. At least in Massachusetts, if you were taken to the hospital for anything related to the crime you are alleged to have committed – this is usually in the context of drunk driving, especially if an accident happened and you are brought to the hospital – they are probably going to take your blood alcohol content at the hospital. The first time you are in court after that happens, the government is going to move to get copies of those medical records and they are going to get them. The judge is going to say, “sure, that sounds like a great idea,” sign a court order, send it over to the hospital and before you know it, the government has your medical records.

So, keep that in mind. If you go to the hospital and it is related at all to a potential criminal action, whatever happens at a hospital or with doctors, can and absolutely will be found out by the prosecution.
