Mahira Homes-95 is a PM affordable group housing scheme launched by CZAR buildwel pvt Ltd Gurugram having office at Global Foyer mall, Golf course road gurugram in October 2020 and 2BHK and 3BHK Flats allotted to people in December 2020 and buyers deposited 25% payment within 15 days of allotment and thereafter regularly paying instalments which is 12.5% amounting to Rs 331167/- every 6 months but construction is only 5% even after receiving 50-62.5% which is around 13-17 lac rupees payment upto June 2022 from allottees. The DTCP Blacklisted the builder in July 2022 due to Financial irregularities in their accounts and transfer of project money from Escrow account to free account and illegal withdrawal from that account with the planned involvement of bankers. So allottees stopped paying instalments thereafter. But Later DTCP withdraw its order of blacklisting the builder on the condition that builder will deposit back the money illegally withdrawn from Escrow account, Conversion of payment plan from TLP to CLP that is Construction Linked, Revoking of Cancellation of flats of allottees and Raising demand of next instalment only after the completion of construction in proportionate to money already received from the allottees upto the satisfaction of Senior Town Planner STP Gurugram. But in a later order the DTCP allows the builder to charge the instalments according to original payment plan which is Time Linked. But Construction is stopped from last 1 year and builder is demanding next instalment according to Time Linked payment plan and threatening Cancellation on Non-payment of instalment money by giving reference to DTCP order of charging instalment according to original payment plan that is TLP. The allottees of Mahira Homes-95 protested and submitted memorandum of their demand to Haryana Rera and DTCP Gurugram on 14 March 2023 under banner of Mahira homes-95 Flat Owners Association Headed by Arpit kumar, Naresh kumar Narula, Ramesh kakkar, Kirti Kakkar, Pankaj, Jose Mathew etc which includes 1)the conversion of payment plan from Time Linked to Construction Linked (CLP) 2) Stay on Flat Cancellation Notice and Restricting Mahira Builder from cancellation of flat at Mahira Homes-95 as builder itself Violated and defaulted the rules and regulations of HRERA and DTCP 3) To start construction at rapid pace at Mahira Homes-95 4) payment of next instalment only after completion of at least 50% Construction by builder. Allottees also said that they are ready to pay instalments if builder start construction at rapid pace and complete the project upto 50% and banks will also start disbursement thereafter. HRERA and STP Sh Sanjeev Mann on behalf of DTCP assured that decision will be taken in best interest of allottees.
