Today I want to explore a subject that can be confusing and that is often misunderstood by many homeowners- What to expect from your mortgage company in a foreclosure lawsuit.
Once you've missed a payment, you can expect to start receiving endless, nagging phone calls from the mortgage company. They will hound you for payments. Homeowners are often pressured into cashing out their 401k's, selling vehicles, or borrowing from relatives.
When speaking with the bank, it's common to receive inconsistent, conflicting, and often misleading information. This can include payment amounts, due dates, and "special arrangements" that sound promising, but will ultimately make the situation much worse for you.
For this reason, I always encourage homeowners to keep good records of all correspondence with their mortgage company.
Lenders will try to threaten and intimidate you, while asking you for the same documents over and over. Homeowners who do not have legal representation are an easy target and often get taken advantage of.
Unfortunate examples of these predatory tactics include: pretending to work with you on a solution while, at the same time, continuing the foreclosure process. Mortgage companies offer you the moon, and even tell you to stop making payments. However, in reality, most give you nothing, and then demand exorbitant late fees in addition to your regular payments.
What's more, they don't tell you (or they inform you too late) that when in the trial period for a loan modification, your payments are not being credited to your mortgage balance. Add to this a mountain of confusing, time-consuming paperwork and it's no wonder that so many homeowners are desperate for help in these situations.
