Police Catch Man Wearing Ski Mask Infront of ATM Claiming he was cold.
On February 21, 2025, at approximately 2332 hours, a deputy was on routine patrol in the unincorporated area of Boca Raton, Florida, when a male subject was observed standing at the drive-through ATM of a Wells Fargo Bank located at 22893 Sandalfoot Plaza Drive, Boca Raton, FL 33428. The male was later verbally identified.
The deputy is a member of the P.B.S.O. District 7 Street Crimes Unit. At the time of the incident, the deputy was operating an unmarked patrol vehicle and was wearing a black tactical vest with the word "SHERIFF" displayed on the front and back, clearly identifying law enforcement status. The deputy was also wearing an issued Class "C" uniform.
The subject was seen standing at the ATM in an area designated solely for vehicular traffic. He was wearing a full-face mask (commonly referred to as a ski mask), a t-shirt, and gym shorts. The wearing of a facemask in public is a violation of F.S.S. 876.12. After completing a transaction at the ATM, the subject began walking eastbound. At that time, the deputy exited the vehicle and made contact with him. After identifying as law enforcement, the deputy asked the subject why he was wearing a facemask. In response, the subject removed the mask but began to walk away. A lawful command was issued instructing him to stop, which he ignored. As he continued walking away, the deputy took control of his elbows, placed his arms behind his back, and informed him that he was being detained for wearing a facemask in public. He was then handcuffed to the rear, ensuring proper fit and spacing.
During the detention, the subject stated that he had a pre-existing injury on his right hand with stitches. Initially, he refused to identify himself, claiming that he was not lawfully detained. After multiple requests, he verbally identified himself. An F.C.I.C. / N.C.I.C. records check revealed that he was on probation for burglary out of Broward County and had an open criminal case in Palm Beach County. At this time, he was informed that he was under arrest.
A search incident to arrest revealed that the subject was in possession of a Florida driver's license (FL D.L.) and a Wells Fargo debit card, neither of which were in his name. Both items were issued to another individual. It should be noted that the subject did not have any cash on him, and the only items found in his possession were the facemask, FL D.L., and debit card. When questioned about the cards, he stated that his roommate had given him the items to withdraw cash from the ATM. However, he also stated that the roommate was not present and was at home. Multiple attempts were made to contact the roommate with negative results. If it is later determined that the subject did not have permission to possess these items, a separate case will be generated.
As the deputy attempted to place the subject into a patrol vehicle, he stated that he was not under arrest and physically resisted being placed inside. Once again, the deputy took control of his arms and escorted him into the patrol vehicle. The subject later claimed that he was wearing the facemask because he was cold. However, it should be noted that he was wearing a t-shirt and gym shorts while standing at a drive-through ATM at 2330 hours in an empty bank parking lot.
Probable cause was found to charge the subject with wearing a facemask in public (F.S.S. 876.12), resisting without violence (F.S.S. 843.02), and violation of probation (F.S.S. 948.06).
The subject was medically cleared at a local hospital for the preexisting stitches in his hand. A sergeant was called to speak with him per his request. Once the proper paperwork was completed, he was transported to the main county jail by another deputy. The deputy’s body-worn camera was activated for the duration of the incident. All evidence was packaged and placed in a District 7 evidence locker.
