COHABITATION AGREEMENTS
A cohabitation agreement in Nevada is a contract between an unmarried couple who live together. Like a prenuptial agreement, it spells out how you will divide property should you eventually break up. Here are three things to know:
1) Cohabitation agreements can be made in writing, verbally, or through conduct. But it is highly advised that you put cohabitation agreements in a notarized contract. Otherwise, the terms can be very difficult to prove if you try to enforce the agreement in court.
2) Cohabitation agreements allow unmarried couples to choose any property arrangement you want. You can agree to own property as if it was community property, which is the default rule for married couples, or you can agree to keep everything separate, or do a combination of both. Another common term in cohabitation agreements is palimony, which is where one person makes financial support payments to the other in the event of a breakup. Couples can also include provisions on child custody arrangements and who has the right to make medical decisions.
3) Any couple who is living together is encouraged to have a written cohabitation agreement to protect your property rights should you ever go your separate ways. It is a lot easier to have guidelines to follow that you both agreed to ahead of time. And it is never too late. You can enter into a cohabitation agreement even if you’ve already been living with each other for a long time.
