Many parents ask: Does the court still have the power to change custody orders? The answer is yes. If your youngest child is under 18 (or under 19 and still in high school full-time), the court retains jurisdiction and can modify custody or visitation orders based on the circumstances.

But it’s not as simple as asking the judge for a new arrangement. Post-judgment custody modifications require proof of a significant change in circumstances. This critical legal standard must be met before the court even considers what’s in the child's best interest.

Examples of a significant change might include:
A major change in your work schedule
Relocating to a different city or state
Safety concerns (physical, emotional, or otherwise)
A co-parent’s inability to maintain the current schedule
Substance abuse or other serious issues

Once this change is proven, the court can re-evaluate what parenting plan best supports the child’s well-being.
